Terms of Service

Welcome to Future. By creating an account and using our application, you fully accept these Terms of Service (ToS). Please read them carefully.

1. User Account

To use Future, you must create an account. The following rules apply:

• You must be at least 15 years old to create an account in accordance with GDPR regulations.
• You are solely responsible for the security of your login credentials.
• You agree to provide accurate and up-to-date information when using our services.

2. Your Memories and Content

You retain all intellectual property rights to the content you upload. By using Future, you declare that:

• You will not publish any illegal, hateful, violent, defamatory, or pornographic content.
• You own the necessary rights to the content you import.
• You grant Future a non-exclusive, royalty-free, worldwide license to host, store, reproduce, technically adapt (compression, format conversion) and transmit this content to the recipients you choose, solely to provide the service and for as long as it is kept. This license ends when the content or your account is deleted.
• We reserve the right to remove any content that violates these rules, without prior notice.

3. Service Availability

We strive to ensure the future delivery of your time capsules. However, the service is provided "as is". We do not guarantee uninterrupted availability and disclaim all liability in the event of exceptional data loss due to force majeure. We strongly recommend maintaining a personal backup of your most precious files.

4. Subscriptions, storage limits and how long your capsules are kept

The storage space available to you depends on your plan, free or paid. By accepting these Terms of Service, you expressly agree to the following rules.

4.1 Changing or ending a subscription

• If you cancel your subscription or move to a lower plan, your storage limit is reduced at the end of the period you have already paid for.
• As long as the space you use exceeds your limit, you can no longer create new photo, video or audio capsules.

4.2 Exceeding the limit: deletion after 30 days

If the volume of your capsules exceeds your new storage limit:

• you are warned by a notification in the app as soon as the excess is detected, then a second time about 7 days before the deadline;
• you have 30 days from the first warning to get back under your limit, by deleting capsules or by subscribing to a suitable plan;
• after that period, Future permanently deletes photo, video and audio capsules you have sent, starting with the most recent ones, until the space you use is back under your limit;
• this deletion may affect capsules that are already scheduled or already delivered to their recipients, who will then lose access to them. Text capsules are not affected.

4.3 Retention guarantee after 12 months of subscription

If you have been subscribed to a paid plan for at least 12 consecutive months, your capsules are no longer deleted for exceeding the limit, even if you later stop your subscription. This guarantee remains yours for as long as your account exists.

• The 12 months are counted as subscription time actually paid for, across all paid plans: changing plan does not reset the count. A yearly subscription earns the guarantee at the end of the paid year.
• A gap of more than 7 days between two paid periods, or the refund of a period, resets the count. One-time purchases, such as the Storage Boost, do not count.
• As long as you exceed your limit, you cannot create new photo, video or audio capsules. Existing ones are kept and will be delivered to their recipients on the planned date.
• Future reserves the right to freeze or archive the capsules that exceed your limit, by moving them to long-term storage. They are not lost: viewing or opening them may simply require a restoration delay.

4.4 Your responsibility

It is up to you to download or sort your memories before any subscription change. The retention guarantee does not apply to the deletion of your account (section 5), to the discontinuation of the service (section 6), or to content that breaches these terms (section 2).

5. Termination and Deletion

You may delete your account at any time via the application settings. This action is final and will result in the irreversible destruction of all your time capsules, including those scheduled for future delivery.

6. Modification and Termination of Service

Future reserves the right to modify, suspend, or discontinue the service at any time. In the event of a permanent shutdown of the application:

• We will notify you by email at least 30 days in advance to allow you to download and export your memories.
• Active recurring subscriptions (monthly or annual) will be refunded on a prorated basis for the remaining period.
• One-time « lifetime » purchases (such as Storage Boosts) are valid for the lifetime of the application and will not be refunded in the event of a permanent closure of the service.
